Former AZGOP Chairman Tom Morrissey: Does anyone know this?  Anyone? Here is 8 US Code §1182 - Inadmissible aliens This law was written in 1952.  It was passed by a Democrat-controlled Congress, House and Senate, and signed by a Democrat president.  "Suspension of entry or imposition of restrictions by president.  Whenever the president finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, the president may, by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants or impose on the entry of aliens any restrictions he may deem to be appropriate."  All of the pundits that are claiming that what Trump said is dumb, stupid, reckless, dangerous, and/or unconstitutional, need to educate themselves.  It is already the law of the land.  And it was utilized by Jimmy Carter, no less, in 1979 to keep Iranians out of the United States, but he actually did more.  He made all Iranian students already here check in, and then he deported a bunch.  Seven thousand were found in violation of their visas, 15,000 Iranians were forced to leave the United States, 1979. You probably won’t hear of this from our mainstream media (nor from our narcissist-in-chief), but those are the facts.

Maricopa County Sheriff Candidate Marsha Hill introduced herself as a challenger to Sheriff Joe Arpaio at the Sun City West Republican Club today.

Chatter Is Circulating Over AZGOP Chairman Robert Graham checking into the possible Recall of Phoenix City Councilman regarding satanic prayer issue. As you may recall, Graham himself just escaped a “Resolution to Censure Robert Graham” from getting to the Jan 23 State Meeting floor for a vote -- via a parliamentarian ruling. Prior to the state meeting, there was debate among precinct committeemen who want him gone as to whether to recall or censure Graham, but it was decided not to attempt to recall him during an election year.

The deadline for all bills to be heard in committees in their originating chamber (House or Senate) is Friday, February 19, less than two weeks away.    Most of the bills we are monitoring will not survive that deadline.

RTS Sucess!We thank everyone who used their RTS accounts to contact committee members about legislation this past week.  Thanks in large part to your activism, the following key bills passed out of committee this week.
     HB 2081, which would prohibit checking with any federal (e.g., NICS) or state database on private property transfers, passed out of the House Commerce Committee on February 3.
     SB 1257, the AzCDL-requested bill that would exempt CCW permit holders from being disarmed when entering state and local government controlled property unless everyone entering is screened for weapons, passed out of the Senate Government Committee on Wednesday, February 3.
     SB 1266, which would allow for injunctions, fines and civil suits when state agencies or local governments disregard state firearm preemption statutes, passed out of both the Senate Public Safety, Military & Technology Committee and the Senate Government Committee on Wednesday, February 3.

Former MCRC Chairman A J LaFaro Sets The Record Straight about ballot harvesting, stuffing and tampering legislation with acknowledgment to a few individuals who helped lead the charge and worked tirelessly to make these egregious activities illegal in Arizona:
Secretary of State Michele Reagan, Reps Michelle Ugenti-Rita, Anthony Kern, J. D. Mesnard,Eddie Fransworth, Sen Don Shooter, Maricopa County Recorder Helen Purcell, Maricopa County Elections Director Karen Osborne, and Phoenix City Councilman Sal DiCiccio. There are countless more.
     In February 2013, Reagan, Purcell and Osborne asked me to testify at the Arizona Senate Elections Committee Hearing on SB1003 legislation that would make ballot harvesting illegal.  I spoke out as the newly elected Chairman of the Maricopa County Republican Committee (MCRC).  Unfortunately, Arizona's progressive socialist and RINO legislators prevented SB1003 from becoming law.

     During the 2014 and 2015 AZ legislative sessions, I continued to lobby and testify in favor of legislation to make ballot harvesting, stuffing and tampering illegal in Arizona.
     In August, 2014, as MCRC Chairman and while acting as the official liaison between the Republican Party and Maricopa County Elections, I witnessed and proved that ballot harvesting, stuffing and tampering does occur in Arizona.  The video has been viewed almost 550,000 times. See

     In February 2015, I started traveling across Arizona with a PowerPoint presentation concerning ballot harvesting, stuffing, tampering and closing our primaries making presentations to almost 3,000 people at LDs and County Republican Committees, Republican Clubs and Tea Party meetings.

     Feb 2016 - the debate continues at the State Capitol. On Feb 4, Rep Michelle Ugenti-Rita’s HB2023 passed its Third Read with 34 Ayes, 23 Nays, 3 No Vote and was transmitted to the Senate on Feb 5.

Chris Herring To AZGOP Executive Committee Members Today - Title 16 Nomination Reform Bill Proposed: At the AZGOP state meeting in January I discussed the work that has been taking place over the last year to explore ways to bring greater control to the Arizona Republican Party in how we select and nominate candidates for elected office. The proposed bill (see below) that will be sponsored (RepKern) in the Arizona House on Monday. Also see a one pager in which we try to encapsulate the pro and con arguments for such a bill based on our experiences while researching this topic. These arguments aren't meant to persuade in as much as they are intended to help provide a balanced view of this issue and save executive committee members time in researching this issue and answering questions that may be received from PC's.

We are asking that you provide the two attached documents to PC's in your district or county. We also ask that you carefully consider this issue and consider the views of your constituent PC's. We ask that after consideration and seeking the input of your PC's you respond to this email with your vote of support or opposition. This should be considered an informal vote of support and not a formal adoption of any measure or motion by the executive committee. Although we are not placing a time limit on your response we do point out that the house calendar will move quickly. If this body wishes this bill to pass it will be a grassroots effort across the state showing a collective voice of support.

On behalf of the PC's from across the state who made up this committee we want to thank AZGOP Chairman Robert Graham for calling for its formation and allowing us the freedom to research and progress on this issue.

NOMINATION REFORM BILL (PROPOSED)

  • Whereas Citizens reserve the natural right to peaceably assemble into existing political associations commonly known as Political Parties; two of which are predominate in the State of Arizona and as such are known as “Major Parties”, those being the “Democratic Party” and “Republican Party”; another of which being less predominate but sufficiently significant so as to also be considered a Major Party, that being the “Libertarian Party”; and others being so much less predominate as to be considered “Minor Parties”, examples of which being the “Green Party” and “Union Party”;
  • Whereas Citizens reserve the natural right to create new political associations in which to peaceably assemble and in the State of Arizona that is a relatively easy process;
  • Whereas by implication, Citizens also reserve the right to remain independent of political associations if that is their inclination, they being politically known as “Voters with No Party Designation“ or “Political Independents” or simply “Independents”.
  • Whereas current Arizona Election Law violates the natural right of association for two of the three Major Parties in Arizona, the Democratic and Republican Parties, such violation being the forcing of those two parties to accept interference in their doings from Minor Parties and Independents;
  • Whereas current Arizona Election Law violates Citizens Natural Right of Equal Treatment under the Law, when it treats one of the three Major Parties differently than the other two; such being the Court enforced exception which grants the Libertarian Party its Right of Association, while at the same time withholding that right to the Democratic and Republican Parties.
  • Therefore be it enacted by the Arizona Legislature that ARS Title 16 Election Law, Chapter 3, Article 5.1, be revised to add clause 16-349 entitled NOMINATION BY MAJOR POLITICAL PARTY CAUCUS, as follows:

NOT WITHSTANDING ANY OTHER LAW:

  1. A QUALIFIED POLITICAL PARTY MAY NOMINATE ITS CANDIDATES WHO ARE TO APPEAR ON THE PRIMARY ELECTION BALLOT FOR FEDERAL, STATE, COUNTY, AND MUNICIPLE PARTISAN POLITICAL OFFICES EITHER BY POLITICAL PARTY CAUCUS PRESCRIBED BY THIS SECTION OR BY THE PETITION/PRIMARY METHOD PRESCRIBED BY SECTIONS 16-311 AMD 16-314.
  2. A QUALIFIED POLITICAL PARTY SHALL ESTABLISH ITS OWN PROCEDURES FOR NOMINATING CANDIDATES AT THAT POLITICAL PARTY'S CAUCUS AND EACH PARTY'S NOMINEES FROM THAT PARTY'S POLITICAL PARTY CAUCUS SHALL APPEAR ON THE PRIMARY ELECTION BALLOT AS THE CANDIDATES FOR THAT PARTY.
  3. A QUALIFIED POLITICAL PARTY MAY CHOOSE WHICH NOMINATION METHOD IT USES (EITHER PETITION/PRIMARY OR CAUCUS) FOR ANY, OR ALL, OR ANY COMBINATION OF THE FOLLOWING ELECTIONS: A) FEDERAL PRESIDENTIAL ELECTION, B) ELECTION OF THE ARIZONA STATE DELEGATION TO THE FEDERAL GOVERNMENT (SENATORS), C) ELECTION OF THE ARIZONA CITIZEN DELEGATION TO THE FEDERAL GOVERNMENT (REPRESENTATIVES), D) ELECTION OF STATEWIDE ELECTED OFFICIALS, E) ELECTION OF COUNTYWIDE ELECTED OFFICIALS, F) ELECTION OF STATE LEGISLATIVE DISTRICT SENATORS AND REPRESENTATIVES, AND/OR G) ELECTION OF MUNICIPAL ELECTED OFFICIALS.
  4. CANDIDATES FOR NONPARTISAN POLITICAL OFFICES AND CANDIDATES FOR PRECINCT COMMITTEEMEN SHALL BE DETERMINED AS OTHERWISE PROVIDED BY LAW.

NOMINATION REFORM BILL PROS & CONS

Pros:

· The closed primary system violates the right of free association guaranteed in the constitution. This bill allows a mechanism to restore this right of association to Major Political Parties in the State of Arizona.

· Nothing must change with passage of this bill. It simply allows freedom to Major Political Parties to choose either nominating petitions or caucus method for placing candidates on primary ballot for any elected office in any election.

· It can create a de facto Closed Primary if desired by any Major Political Party. By allowing the party to decide who appears on the ballot prior to the primary the party membership can ensure only members of their party have influence on who is the eventual nominee for an office.

· The office of Precinct Committeemen will have an elevated status. Title 16 currently limits the nomination process to nomination signature petitions. With the addition of a second mechanism available to each party the PC’s will have a say in the overall election process for their party.

· The nomination process would be improved by ensuring that the most informed members of each party have the greatest say in how the party’s nominees are selected.

· Has the ability to save taxpayers money. Currently the tax payers pay for the Presidential Preference Election. This would allow each party to establish a caucus system for this nominating process saving the taxpayers several million dollars per cycle.

Cons: Note: The con arguments are not meant to represent the views of the committee or any member of the committee. They are presented as arguments which were encountered in the course of our research. It is also important to note that the below arguments largely follow the assumption that after the proposed bill was enacted a caucus system would be established. It is important to understand that the bill does not establish a caucus but merely makes a caucus allowable by law.

· Independent voters may feel disenfranchised as they would no longer participate in the process to place candidates on the primary ballot for any party which utilized a caucus nominating mechanism.

· Options in the primary election may become limited to only a single candidate depending on the rules established by a party choosing to utilize this method.

· “Establishment” elements may try to wield more influence in which electors occupy the office of Precinct Committeeman.
