What’s With This “Happy” Memorial Day stuff? Memorial Day isn’t a celebration, it’s a day of remembrance for those fallen warriors who have gave their all so this nation can remain free. Retired Navy SEAL Robert J. “Rob” O’Neill hit the nail on the head when he wrote, “This holiday isn’t meant to be a time of celebration but rather one of “reflection, pause, remembrance and thanksgiving.” O’Neill, the man who killed Sept. 11 mastermind Osama bin Laden, wrote why he didn’t want anyone to wish him a “happy” Memorial Day this past weekend. Instead he wants them to remember the fallen. “There is nothing happy about the loss of the brave men and women of our armed forces who died in combat defending America. Memorial Day is not a celebration,” he explained in a column for Fox News. There Have Been Repeated Reminders printed/posted that Sen John McCain’snew book reveals that he made a mistake by selecting former Alaska Gov Sarah Palen as his running mate in the 2008 National elections. Perhaps he forgets that she was doing just fine in Alaska without him, but she gave up her governorship to partner with him. In return for doing him a favor, the attractive, successful, outspoken young woman became the brunt of mean-spirited comments from McCain’s puppets – probably in resentment of her drawing more attention than the senator did. Activist Dennis Zinke: For those of you who considered the birth certificate to be insignificant when Sheriff Joe was investigating our former president why is it being brought up again now! I haven’t heard anything on mainstream media yet, but I have a hunch it will be coming out soon. Below is one of the links that first aired the issue. To me the birth certificate was the most basic of issues. We are a land of law and if we held Herman Cain, Richard Nixon whose Watergate scandal palled in light of Obama and the Democratic Party and let’s not forget Bill Cosby. Seems like you have to commit a sexual crime before the media will even look at you. Trey Gowdy mentioned something about this new finding. We didn’t even want to believe the findings of our own Sheriff and then when he was being attacked by Obama in the courts we seemingly turned our backs on a man who did much to the office of Maricopa County Sheriff. His investigation is now vindicated and I applaud him for not backing down. He did what he was asked to do. When we turn our backs on wrong and then look for justice ourselves when we have been wronged we can’t expect anything different. Could it be that JohnMcCain had a hand in all this? LD21 PC Randy Miller: Oath Keepers has used 10 US Code Section 123 - Subtitle A part I (a): In time of war, or of national emergency declared by Congress or the President after November 30, 1980… (Question to readers, where in the Constitution does it give authority to congress to extend powers to the president? It doesn’t.) Our forefathers specifically intended that no one branch of government would hold more power than the other, they deliberately separated each. One branch cannot be in position to make decisions independently over the other. For instance, Congress makes law, but the president has to sign off. Then the courts are supposed to decide, if that law is challenged, if it is within constitutional limits. Congress can override vetoes with 2/3rds vote. This is our checks and balance.

For anyone to argue that the president, or any Act, such as the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122) can circumvent the constitutional checks and balances and grant independent powers to the president, is not respecting the separation of powers and state sovereignty. People can hold titles and make argument in favor of independent power void of the other branch of governments responsibility under our checks and balance doctrine, but titles don’t make it so. We can’t accept that congress can unilaterally pass a law or “Act” that grants Carte Blanch to the president to act independently, thus waiving their constitutional mandate to have an oversight position. To do this makes us more a servant to the king or ruled by an oligarch, not a constitutional republic governed by the people. This is what Oath Keepers is doing.

Let’s take the “Fast Track” the Senate with Iran treaty, changing conditions of approval, simple majority of both houses, violating the constitution. Is it Oath Keeper’s position this is authorized because under Article II Section 2, I think clause 4 that states “He shall have Power, by and with the consent of Congress, (lets ignore the second sentence to argue presidential power) to make Treaties, provided 2/3rds of the Senate concur” (ignore this too).

Oath Keepers wants to argue that Supreme Court decisions saying a law is constitutional makes it so. I say it isn’t always the case and the Judiciary can be wrong. We have to look at the Constitution as written and in its entirety. How about the Obamacare legislation? Article I, Section 9, Clause 4 says: “No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken.” In other words, states were taxed based on “Apportionment” or state population. This provided protection of sovereignty to the states because they were to pay the treasury from state treasuries for those duties enumerated in Article I Section 8. This provided controls over federal actions because the states controlled the purse like Congress is to do. The 16^th amendment stripped the states of some sovereignty and allowed congress to tax individuals. Oath Keepers believes they can use precedent over constitutional law to skip important parts of the constitution. Congress, only has the authority to tax income, not something you don’t have or aren’t “buying”. This ruling was first introduced by the court because the Obama administration denied it was a tax calling it a “penalty. Therefore, I don’t accept the argument by Oath Keepers and Mike Primiano.
