Nearly 5 years to the day after a U.S. Supreme Court ruling set up a dual-track system of elections in Arizona, the state has settled a related lawsuit and has ensured each applicant’s eligibility to participate in state or federal elections will be verified before the individual’s registration becomes active. The bifurcated voting system arose out of a conflict between a 2004 voter approved ballot initiative requiring proof of citizenship when registering and a Supreme Court decision that mandated the state process individuals who register to vote with a federal form without establishing citizenship.

The lawsuit filed by the League of United Latin American Citizens and Arizona Students’ Association, claimed the state’s voter registration process was unduly burdensome, was formally settled on June 4. “We’ve worked hard to settle this lawsuit and are extremely pleased with the result,” said Secretary Michele Reagan. “The registration system will now verify the eligibility of each and every person who has yet to provide evidence of citizenship. With this agreement in place we’ll have confirmed an individual’s eligibility before issuing them a ballot with any state elections listed. While the Supreme Court has ordered Arizona to allow people who have not provided such proof of citizenship to vote in federal elections, it’s a relief the system will now proactively verify eligibility for all applicants.”

“We’ve always said that it should be easy to vote and hard to cheat,” continued the Secretary. “I’m proud to say this compromise achieves both. Voters will now have the clarity they need along with a heightened level of election integrity.”

Maricopa County Recorder Adrian Fontes (D) released this statement praising the settlement reached in a lawsuit regarding the bifurcated voter registration system, which has different proof of citizenship requirements for federal and state voter registration forms. The League of United Latin American Citizens and the Arizona Students’ Association filed the suit against the State of Arizona and Maricopa County in November 2017. Fontes agreed with the lawsuit’s assertion that the process disenfranchised voters.

“The LULAC v. Reagan settlement vindicates the policies of this office in part because it upholds the work that we have been doing to register Arizonans to vote when we are able to confirm their citizenship. I am pleased that the Secretary of State’s Office came to the same conclusions about the voter suppression created by the bifurcated registration system. It did not serve the voters in this county or the state.

“The goal of my office is to make voting accessible, accountable and transparent. Voters should not have to jump through unnecessary hoops once they establish proof of their citizenship with the state. The government has a responsibility to ensure voter enfranchisement. This settlement prioritizes an individual’s right to vote over administrative convenience. This is a proud day for the fight against voter suppression in Arizona.”

Arizona Corporation Commissioners will host a public comment meeting at 3 pm, Tues., June 5 in the Ajo Ambulance Services Building’s Community Meeting Room/Training Room, 1850 N. Ajo Gila Bend Hwy in Ajo, to hear from customers of the Ajo Improvement Company regarding its application for a rate increase for its electric, water, and wastewater divisions. Ajo Improvement Company serves the city of Ajo, Arizona. Its water and electric divisions each have approximately 980 customers, and its wastewater division has approximately 1,032 customers. Commissioner Andy Tobin will be in attendance to hear from ratepayers of the Ajo Improvement Company. Other Commissioners may participate via WebEx to hear the concerns of those impacted by this proposed rate increase. It is important to note that Commissioners will not be able to comment or answer questions, but will be available to hear the concerns of those affected. Although this is the Company’s request, Commission staff will evaluate the application and make the appropriate recommendation to the Commission after due process. Center for Arizona Policy Chairman Cathi Herrod reports that the CAP policy participated in the 7-2 opinion ruling by the US Supreme Court in favor of Colorado cake artist Jack Phillips in Masterpiece Cakeshop v. Colorado Civil Rights Commission. I applaud this ruling for acknowledging that those with deeply-held beliefs about marriage do have a First Amendment right to have those beliefs protected from punishment by the government. Wickenburg activist Nohl Rosen is offering one free hour of computer or IT troubleshooting throughout the month of June “Adopt a Cat Month” to those who adopt a cat from a local animal shelter or rescue. "There are many cats needing good homes. Every year the animal shelters take in a good number of cats, and many of them run out of space really fast. We're hoping this will encourage people to adopt a cat," said Panther TEK's owner Rosen who himself has volunteered in the animal rescue community. Barbara Medal - LD26 PC/SC: It saddens me to hear Happy Memorial Day and to think of this day of honoring our fallen as a celebration and not a day of reverence, reflection and thankfulness of those having given their all. I have three grandsons serving, two sons served, three brothers, uncles, father and grand dads back as far as the Revolutionary War. Each a hero to me for being willing to lay down their lives for this nation and our freedoms. America has become a majority of unpatriotic party-animal young snowflakes. Most people have no idea we are not a Democracy but a Republic and most have no idea of the difference. How many congressmen refer to our ‘Democracy’? If they don’t get it right and it’s not taught in school to our young our nation is doomed. It is up to parents to insist on better education and expect more of their children.

I proudly display my flag on every occasion/holiday and sadly the only household in my neighborhood to do so. I am so dismayed by the lack of patriotism in America today and the lack of regard for our fallen heroes. Early evening on Monday Memorial Day I found my flag on the ground with the pole and holder attached to it still. The screws were still attached maybe it was the wind, though it didn’t seem windy, maybe it was yanked out of the stucco wall, I don’t know but it was a sinking feeling to see our flag laying there on the ground.

ELECTED OFFICALS COMMENTARY

Arrowhead JP Craig Wismer: Are you entering a plea of guilty, not guilty or no contest? This is a question judges ask defendants when they appear in court for their Arraignment Hearings.

Defendants who are cited for violations of criminal statutes possess certain constitutional rights of which the judge is required to advise them at the Arraignment Hearing, one being the ability to enter a plead of not guilty and require the state to prove their guilt beyond a reasonable doubt. If they do, judges will set their cases for something called Pre-trial Conferences. In the Arrowhead Justice Court that occurs about 30 days later. The PTC, as it is known, is a meeting with the prosecutor at which defendants, with or without an attorney representing them, will be able to learn if the state is willing to make an offer for the disposition of the charge(s) that they may want to consider accepting. They may also reject it.

The only way for defendants to be able to meet with the prosecutor to learn what the state may be willing to offer is for them to plead not guilty. Because many defendants appear in Limited Jurisdiction Courts (which includes the Arrowhead Justice Court) without the benefit of legal counsel, judges may choose to spend some extra time at Arraignment explaining to them their options and the potential benefit of pleading not guilty. It is something that I routinely do without offering any guarantees as to the outcome. That being said, it surprises me how often defendants choose to enter pleas of guilty the very first time that they appear in court. I don’t think that the court should take a proactive role in steering them away from this course of action—it is a choice they need to make. However, I do find that offering illustrations of potential results can be an effective tool in helping them make an informed decision.

Judges are only required to ascertain a defendant’s plea at the Arraignment Hearing—they are not also required to conduct at that time a required conversation before accepting it. As such, if defendants insist on entering pleas of guilty, I will calendar those cases for Guilty Plea Hearings. They will return to the Arrowhead Justice Court in the near future to either tell me that they are maintaining their plea or entering a change of plea to not guilty. Corporation Commission Chairman Tom Forese: RE: In the matter of the Commission’s investigation of the billing and water quality issues of Johnson Utilities, LLC, Docket No. WS-02987A-18-0050 -- It was reported to me that Johnson Utilities recently pulled over 30 water meters across San Tan Valley causing multiple construction projects to stop. This lack of water has also prevented the construction teams from controlling dust, leading to potential ADEQ violations. It is my understanding that the construction projects were not notified in advance about the meters being pulled, and that in some cases, representatives of Johnson Utilities stated that the utility was not required to provide water to the construction projects.
The Commission has also been informed that a Johnson Utilities well motor failed during the week of May 28, causing the well to go offline. I suspect that this system failure was the cause of certain customers experiencing lower-than-usual water pressures, resulting in Johnson Utilities curtailing its water services at the construction projects.
A utility the size of Johnson should maintain a built-in redundancy pump system such that an immediate back-up would take over in the event of any well motor failure. Moreover, a utility of this size should likewise have a replacement well motor onsite to replace any failed equipment. I would like Johnson Utilities to promptly explain why the failed well motor was not equipped with a built-in redundancy system. I would also like Johnson Utilities to promptly explain why it did not have replacement equipment onsite to address this system failure. Given these shortcomings, I would expect Johnson Utilities to have overcompensated on its customer service by providing more adequate and advance notice to the construction projects. Unfortunately, it was reported that Johnson Utilities simply terminated the water supply without any prior notice to the construction projects.
It is apparent to me that Johnson Utilities continues to struggle in its ability to operate a reliable water system and provide the heightened level of customer service expected by the Commission. I look forward to discussing these issues with my fellow Commissioners when we consider whether to appoint an interim manager for Johnson Utilities.

Chandler Vice Mayor Nora Ellen resigned as expected when she filed her candidate signatures to run for the State House of Representatives. Arizona’s Resign To Run laws require that a sitting officeholder leave office if they are running for a different office and are not in their last year of service. “It was an honor to serve the people of Chandler on the City Council and I’m proud of everything we were able to accomplish.” said Ellen, who continued “We passed six sound balanced budgets in a row, brought new employers and good high-wage jobs to Chandler, kept our AAA bond rating, delivered quality service to the people who live here, and kept our taxes low.“ Those accomplishments are very similar to Ellen’s goals for the State Legislature – balanced budgets, keep Arizona’s economy growing and job market strong, make state government more efficient and responsive, and keep taxes low. Additionally, Ellen will be able to focus on additional issues that are important to her, like education, school/teacher funding, border security, health care, protecting constitutional rights like the 2^nd Amendment, and working to stop federal encroachment on Arizona’s state rights.

Supt of Public instruction candidate Frank Riggs: Well, the liberal media is at it again, insisting there's no place for the teaching of creationism or intelligent design in our schools. One reporter who fancies himself a hard-hitting investigative journalist even tweeted at me that "...in the general election, support for teaching creationism in science classroom is pure poison." Never mind I've repeatedly stressed that creationism should supplement, not supplant, the teaching of evolutionary science and be taught as historical theory in the context of the world's great religions which are all based on the belief in a supreme being or God.

I think it's important for our students to learn about the great religions of the world which have been the catalyst for so much recorded history for centuries. Teaching religious history is quite different than encouraging the practice of a particular religion or set of religious beliefs. So my challenge to these liberal commentators and other strict secularists is this: Do you want to raise an entire generation of students who are historically and civically illiterate? Should we not teach the Declaration of Independence in public schools? After all, it explicitly states, "We hold these truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights..." This is the document from which our rights and freedoms flow. The Declaration of Independence was the promise; the Constitution was the fulfillment. Our government exists to protect and secure the rights of the people. That's the system of self-government we inherited from our Founding Fathers and the Framers.

To this day, every session of the U.S. Congress, in both the House and Senate, begins with a prayer offered by the chaplain (or a visiting minister) and the Pledge of Allegiance with it's reaffirmation of "one Nation under God." In the context of our founding documents, which every student should learn to prepare for responsible adult citizenship, God is not an abstract concept, but the Creator of man and the Endower of man's natural rights.

By insisting on the teaching of evolutionary science to the exclusion of creationism – and the role of our Creator as the source of the eternal human rights on which our government is based – the secularists deprive our students of the essential knowledge they need of our country’s founding ideals and documents. And we wonder why we have a crisis in civics education today and why so many young people are failing to learn who we are and what we stand for as a country; and are ill-prepared to assume the responsibility of every emerging generation to preserve our rights and freedoms...and the greatness of America.
